Where the Controller is satisfied that an application under regulation 43 complies with
section 38(1) of the Act and accepts the application or accepts it subject to any conditions
or limitations to which the applicant does not object, the Controller shall publish the
application setting out -

(a)

the filing date and, where applicable, the priority date;

(b)

the representation of the mark;

(c)

(c)

an indication of the corresponding class or classes of the –

(i)

goods;

(ii)

services; or

(iii)

goods and services;

as appropriate, of the International Classification;

(1)

(d)

the name and address of the applicant; and

(e)

the name and address of the approved agent, if any.

Any person may within a period of 3 months from the date of publication of an
application for the registration of a mark lodge an opposition to its registration
with the Controller by way of notice.

(2)

A notice under paragraph (1) shall-

(a)

state the grounds of opposition; and

(b)

be accompanied by such evidence in support of the opposition, where

appropriate.
