Registration of the mark shall not confer upon
the owner the right to preclude third parties
from using the trademark in relation to. the
goods lawfully sold in any country under that
trademark, provided that these goods have not
undergoneany change.

Registration of a trademark shall not confer
upo~ its owner the right to preclude third
parties from bona fide use of their names,
addresses,pseudonyms, a geographical name,
or exact indications concerning the kind,
qu.al!ty, .quantity, desti~ation, value, place ~f
origin, tIme of production or supply of their
goods or services, in so far as such use is
co~fined to. the purposes of ~ere !dentific~tion
or informatIon and cannot mlslea~ the publIc as
to the source of the goods or services.

A request for transfer of rights on a regist~red
trademark or an application for registration .of a
trademark shall be submitted. in writing to the
office. The application shall be accompanied
with the agreementof transfer of right.

consent of all the co-owners.

The right to a trademark can be transferred in or
without connection with the business in which
it is used. In case where there is a transfer of
the business,the right to the trademark that is
attached to the business passesover to the new
owner, unless othetwiie:agreed.

The Office may, refuse to effect the transfer,
under Sub-Article (4) of this Article, of a
trademark separatelyfrom the businesswhere it
finds that use of the trademark by the new
owner may misreadthe public.
