(6) The time limit for appealing to the Tribunal
against a decision by which the Managing
Director rejects an application under subsection
(2), (3), (4) or (5) of section 43 of the Act is
ninety days after the date of the notice of the
rejection.
Examination as to
substance, s. 44 of
the Act.

28. (1) This Regulation prescribes the details of the
requirements and procedure under section 44 of the Act.
(2) A request for an examination of an
application, submitted under section 44(2) of the
Act, shall be in Form IP 8.
(3) If an application is withdrawn after a request
for an examination has been submitted but before
the examination has begun, the fee paid with the
request shall be refunded.
(4) The following are relevant documents for the
purposes of section 44(4) of the Act —
(a)
the report of any search;
(b)
if priority is claimed, foreign documents
relating to the invention; and
(c)
any other document the Managing Director
considers relevant.
(5) The following apply with respect to the
submission of the copy of the report of the
findings of the examination by the Managing
Director to the applicant under section 44(4) of
the Act —
(a)
the Managing Director shall submit the
copy within thirty days after the report is
submitted to the Managing Director; and
(b)
the Managing Director shall include with
the copy an explanation of whether or not
