Article 25
(Exploitation license)
1. An industrial design may be exploited, in whole or in part, only through the use
of a license from its owner, without prejudice to the ownership right of said
owner.
2. Unless otherwise provided, the right obtained through an exploitation license
cannot be alienated without the express authorization of the owner of the deposit.
Article 26
(Ownership of an industrial design while an employment contract is in
force)
The provisions of Article 12 shall apply, mutatis mutandis, to industrial designs
created while an employment contract is in force.
Article 27
(Nullity of an industrial design)
Deposit certificates for industrial designs shall be null and void in the following
cases:
a) where it is recognized that the requirements stipulated in Article 17 have not
been met;
b) where it is established that the industrial design should be deemed to be an
invention;
c) where they have been granted in violation of the rights of third parties;
d) where some legal step was omitted in the process of granting the certificate.
Article 28
(Lapse of an industrial design)
The following shall cause the deposit of an industrial design to lapse:
a) failure to exploit it for one year;
b) the remaining reasons listed in Article 14.
