Presumption of ownership and existence of copyright
Article 38(1) – In civil, administrative and criminal procedures, the person whose name is
usually indicated as being the author, performer, phonogram producer or publisher is, unless
proved otherwise, considered to be the right holder, and as a result is entitled to bring an
action. Unless proved otherwise, copyright or related rights remain for the work, performance
or phonogram.
