Article 46. Use of graphic or three-dimensional works located in a public place. –
The author may not prohibit the reproduction or communication of a graphic or threedimensional work that is permanently located in a place open to the public, unless the
image of the work is the main subject of such reproduction, broadcast or communication
and is used for commercial purposes.
Section II. – Droit de suite
Article 47. Purpose. – Notwithstanding any assignment of the original work, the
authors of original graphic and three-dimensional works and manuscripts shall have an
inalienable right to a share in the proceeds of any sale of that work or manuscript at a
public auction or through a dealer, after the first transfer of ownership.
