(h) allocate radio frequencies in a manner which will avoid harmful interference,
particularly in relation to safety and allergic services; and
(i) ensure that an appropriate amount of radio frequency spectrum is available for
government as well as non-government use.
Prohibition
on sale etc. of
radio
transmitter
(1) No person shall sell, or otherwise dispose of, to any person who has not been
granted a licence under this Act, a radio transmitter, whether or not it is assembled.
(2) The onus shall lie on a person who deals in or sells radio communication equipment
to ensure that any person who intends to buy or lease such equipment from him has been
granted a licence under this Act.
(3) Any person who contravenes the provisions of this section shall be guilty of an
offence and shall be liable to a fine of not less than P10 000.00 but not more than
P500 000.00.
Radio
receiver and
transmitter
disturbances
(1) The holder of a licence under this Act shall ensure that any radio transmitter or
receiver used or operated by him does not disturb or interfere with the use of another radio
transmitter or receiver, and shall, where such disturbance or interference occurs and he is so
requested by any person, ensure that the disturbance ceases or is reduced to the extent
possible.
(2) Any person who contravenes the provisions of subsection ( 1 ) shall be guilty of an
offence and shall be liable to a fine of not less than PS 000.00 but not more than P20 000.00.
