Complaints to Online Consumer Affairs Committee

40. (1) A consumer may lodge a complaint with the Online Consumer Affairs Committee in respect of any non-compliance with the provisions of this Chapter by a supplier.

(2) After the committee has investigated the matter, it may after giving the supplier
an opportunity to be heard –

(a) order the supplier to comply with the provision of this Act which has been
contravened; or

(b) impose a fine not exceeding N$20 000 which fine may be collected as a debt
due to the state.

(3) A supplier who fails to comply with an order made in terms of subsection (2)(a)
commits an offence and is on conviction liable to a fine not exceeding N$50 000 or imprisonment for a period not exceeding one year or to both such fine and such imprisonment.
CHAPTER 5
ACCREDITATION OF SECURITY SERVICES OR PRODUCTS

Security products or services

41. (1) A product or service may be accredited by the Authority to comply with
the requirements of one or more classes prescribed under subsection (2) if such product or
service –

(a) has as its purpose the encryption or decryption of data;

(b) ensures that data has not been altered;

(c) ensures that data has been altered or created by a specific person only;

(d) creates keys for the encryption or decryption of data;
