committee and which may cause a conflict of interest in the proper performance of his or
her duties as such a member, he or she must disclose that interest to the Council or to the
committee as soon as is practicable after the relevant facts have come to his or her knowledge.

(2) A person who has an interest referred to in subsection (1) –

(a) if he or she is present at a meeting of the Council or the committee at which
the matter is to be considered, must disclose the nature of his or her interest
to the meeting immediately before the matter is considered; or

(b) if he or she is aware that the matter is to be considered at a meeting of the
Council or the committee at which he or she does not intend to be present,
must disclose the nature of his or her interest to the chairperson of the Council
or the committee before the meeting is held.

(3) A member of the Council or of a committee who has an interest referred to in
subsection (1) may not –

(a) be present during any deliberation; and

(b) take part in any decision of the Council or the committee in relation to the
matter in question.

(4) A disclosure by a member under this section must be recorded in the minutes of
the relevant meeting of the Council or committee.

(5) A member of the Council or a committee may not –

(a) use any confidential information obtained in the performance of his or her
functions as a member to obtain, directly or indirectly, a financial or other
advantage for himself or herself or any other person;

(b) disclose any confidential information obtained in the performance of his or her
