order. The register may, if necessary, thereupon be rectified or altered by the
Registrar.
(3) Wherever an order is made by the Court under the Act the Registrar may, if he
thinks that the order should be made public, publish it in the, Gazette.
Regulation 64—Classification of Goods and Conversion of Specification.
(1) For the purposes of these Regulations, goods are classified in the manner
appearing in Schedule 1.
(2) Where the specification of a registered trade mark is founded on Part 3 of the
Schedule to the Trade Marks Ordinance, (Cap. 180), the registered proprietor may
apply to the Registrar on the prescribed form for the conversion of that specification
so that it may be founded on Schedule 1 of these Regulations, whether with or
without the striking of goods therefrom but so that the registration retains its original
date. Thereupon the Registrar shall send the registered proprietor a written proposal
showing the form which, in the Registrar's view, the amendment of the register
should take. (The proposed conversion shall be advertised.)
(3) When a proposal for the conversion of a specification in accordance with this
Regulation has been advertised and has not been opposed and the time for notice of
opposition has expired, or having been opposed the opposition has been determined
and a conversion allowed, the Registrar shall make all the entries in the register
necessary to give effect to the conversion in accordance with the proposal as
advertised, or the proposal as amended after opposition or appeal thereon and
published subsequently in the Gazette and shall enter in the register the date when
such entries were made. The expression "the expiration of the last registration" shall
have regard to the same date in the case of all the resulting entries for the purpose
of determining the next renewal thereof in accordance with section 20 of the Act as it
had with regard to the registration before conversion.
(4) Two or more registrations of a trade mark in respect of goods falling within the
same class of Schedule 1 to these Regulations, having the same date of registration,
may be amalgamated upon conversion in accordance with this Regulation.
Regulation 65—Fees.
The fees to be paid in respect of any matters arising under the Act shall be those
specified in Schedule 3.[sic]
Regulation 66—Forms.
The forms to be used for the purpose of the Act or these Regulations shall be those
specified in Schedule 3.
