(6)	
A	 trade	 mark	 which	 has	 been	 validly	 registered	 in	 terms	 of	 the	
provisions	 of	 section	 53	 of	 the	 repealed	Act	 must,	 from	 the	 date	 of	 commencement	 of	
this	Act,	 be	 deemed	 to	 be	 a	 trade	 mark	 registered	 in	 terms	 of	 this	Act,	 but	 may	 not	 be	
removed	from	the	register	in	terms	of	the	provisions	of	section137	(h)	or	of	section	176	
within	a	period	of	10	years	from	the	date	of	commencement	of	this	Act.
Short title and commencement
241.	 (1)	
This	Act	is	called	the	Industrial	Property	Act,	2012	and	comes	
into	operation	on	a	date	determined	by	the	Minister	by	notice	in	the	Gazette.
	
(2)	
Different	 dates	 may	 be	 determined	 under	 subsection	 (1)	 in	 respect	 of	
different	provisions	of	this	Act.
	
(3)	
Any	reference	in	any	provision	of	this	Act	to	the	commencement	of	this	
Act	 must	 be	 construed	 as	 a	 reference	 to	 the	 date	 determined	 under	 subsection	 (1w)	 in	
relation	to	that	particular	provision.
