General provisions
Article 188
Any infringement of the rights of the owner of a patent, a certificate of addition, a
certificate for a layout design (topography) for integrated circuits, a certificate of
registration for an industrial design or a certificate of registration for a trademark or
service mark, as defined in Articles 53, 54, 98, 122, 123, 153 and 154 above
respectively, shall constitute infringement.
The offering for sale, marketing, reproduction, imitation, use, stocking with a view to
use or marketing of an infringing product shall incur the liability of the infringer,
regardless of whether the acts are committed by the manufacturer of the infringing
article.
Article 189
Infringement proceedings may be brought by the owner of the patent, certificate of
addition, certificate of layout design (topography) for integrated circuits, certificate of
registration for an industrial design or certificate of registration for a factory mark,

However, the beneficiary of an exclusive right to work may, unless the licensing
contract provides otherwise, bring infringement proceedings where, after having been
given formal notice to do so by a bailiff or registrar, the owner fails to bring such
proceedings.
