regarding travelling, subsistence, remuneration and other expenses and allowances
payable to a person or entity referred to in subsection (3)(d)(ii).
(7)

The Cabinet member responsible for policing must, at the end of

each financial year, submit a report to Parliament regarding progress that has been
made towards achieving the objects and functions of the National Cybercrime Centre.

Cyber Command

55.

(1)

The Cabinet member responsible for defence must, in consultation

with the Cabinet member responsible for national financial matters—
(a)

establish a Cyber Command as part of the Intelligence Division of the South
African National Defence Force contemplated in section 33 of the Defence Act,
2002 (Act 42 of 2002); and

(b)

equip, operate and maintain the Cyber Command.
(2)

The Cabinet member responsible for defence exercises final

responsibility over the administration and functioning of the Cyber Command.
(3)

(a)

The Chief of the South African National Defence Force must

appoint a member or employee from the South African National Defence Force—
(i)

who, on the grounds of his or her technical knowledge and experience, is a
suitable and qualified person; and

(ii)

to whom a security clearance has been issued in terms of section 37 of the
Defence Act, 2002 (Act No. 42 of 2002),

as General Officer Commanding of the Cyber Command.
(b)

The General Officer Commanding must exercise the powers

and perform the functions and carry out the duties conferred upon, assigned to or
imposed upon him or her by the Chief of the South African National Defence Force or
under this Act, subject to the control and directions of the Chief of the South African
National Defence Force.
