(ii)	 includedinanaudio-visual work forcinemaortelevision only
by wayofbackground or as incidental to essential matters
represented,
(g)	 subject to subsection (4), the reproduction in the media or the
communication tothepublic of
(i)	 political speech deliveredin public,
(ii)	 speech delivered inpublic during legal proceedings, or
(iii)	 lecture,address, sermonor otherworkof a similarnature
delivered inpublic,
where the use by reproduction or communicationto the public is
exclusively for the purpose of reporting fresh events or new
information.
(2) The permission undersubsection (1)(a) shall notextend toreproduction
(a)	 ofaworkofarchitecture intheformofbuilding orotherconstruction;
(b)	 in the form of reprographyof a whole or of a substantialpart of a
~r of musicalwork in theform of notation;
(c)	 ofthewhole orofa substantial partofa database indigital form; and
(d)	 of a computerprogram,except as providedin section 16.
(3) Paragraph (b) ofsubsection (1)doesnotapply inrespect ofanyparticular
quotations unlessthe quotations referredto in that paragrapharecompatible with
fair practiceand the extentof the quotationsdoesnot exceed what isjustifiedfor
the purposeof the work in whichthe quotations are used.
(4) Paragraph (c) ofsubsection (1)doesnotapply inrespect ofanyparticular
work unlessthe use referredto in that paragraphis compatiblewith fair practice
and the source of the work used and the name of the author are indicated in the
relevant publication, broadcast or recording.
(5) Paragraph (g) of subsection (1) doesnot applyunless the reproduction
referred toin thatparagraph andthenumberofcopiesmadein thereproduction are
limited to whatisrequired in theparticular circumstances.
(6) Despitethe provisions of section 5(a) the temporary reproduction of a
work is not an infringementof copyright if the reproduction is made in order to
makea digitally storedworkperceptible or in the processof a digital transmission
(a)	 by a personwho or entity that is authorisedfor thatpurpose by
(j)	 the ownerof the copyright; or
(ii)	 operation oflaw; and
(b)	 as an accessory that occurs during the normal operation of the
