(2) The Court shall fix the amount of the fine, taking into
particular account, the defendant's profits attributable to
the infringement.
(3) The Court may increase up to double the upper limit
of the penalties specified in subsection ( 1 ), where the
defendant has been convicted for a new act of
infringement within five years of a previous conviction
for an infringement.
(4) The Court shall also apply the measures and
remedies referred to in sections 51 and 52 in criminal
proceedings, if no decision has yet been taken on those
remedies in a civil proceeding,

54. ( 1 ) The following acts are unlawful and, in the
application of sections 49 to 52, shall be assimilated to
infringements of the rights protected under this Act ­
(a) 	the manufacture or importation for sale or
rental of any device or means specifically
designed or adapted to circumvent any device
or means
intended to prevent or restrict
reproduction of a work, a sound recording or
a broadcast, or to impair the quality of
copies made;
(b) the 	manufacture or importation for sale or
rental of any device or means that is
susceptible to enable or assist the reception of
a programme, which is broadcast or otherwise
communicated to the public, including by
satellite, by those who are not entitled to
receive the programme;
