“intermediary”, with respect to a particular data message, means a person who, on behalf of
another person, sends, receives or stores that data message or provides other services with
respect to that data message;

“Minister” means the Minister responsible for technology;

“Ministry” means the Ministry responsible for technology;

“originator” means a person by whom, or on whose behalf, a data message purports to have
been sent or generated prior to storage, if any, but it does not include a person acting as an
intermediary with respect to that data message;

“Permanent Secretary” means the permanent secretary of the Ministry;

“prescribe” means prescribe by regulation;

“secure electronic signature” means an advanced electronic signature complying with the
requirements prescribed under section 20(3) for a secure electronic signature;

“security procedure” means a process involving one or more of the purposes referred to in
section 41(1);

“security product” means a product that as part of its functionality has one or more of the
purposes referred to in section 41(1);

“security service” means a service (including the issuing of digital certificates) which involves
anything with a purpose referred to in section 41(1);

“this Act” includes regulations made in terms of this Act;

“transaction” means an action or set of actions of either a commercial or non-commercial
nature, including the provision of information and e-government services.
