THE ELECTRONIC SIGNATURES REGULATIONS 2012
(Under section 97 of the Electronic Signatures Act, 2011, Act No.7 of 2011)
IN EXERCISE of the powers conferred upon the Minister responsible for
information and communication technology by section 97 of the Electronic
Signatures Act, 2011, and on the recommendation of the National Information
Technology Authority, these Regulations are made, this __________ day of
__________ 2012.
PART I-PRELIMINARY
1. Title.
These Regulations may be cited as the Electronic Signatures Regulations, 2012.
2. Interpretation
In these Regulations, unless the context otherwise requires –
“Act” means the Electronic Signatures Act, 2011.

3. Qualifications to provide certification services
(1) The Controller shall not licence a person as a certification service provider
unless that person meets the qualifications specified in sub regulation (2)
(2) Every person certification services provide shall (a)
have adequate expertise or experience to operate as a certification
service provider;
