order the forfeiture of any equipment or any article used or connected in
any way with the commission an offence;

(b)

order or prohibit the doing of any act to stop a continuing contravention.

Prosecution and jurisdiction
(1)

An authorised officer may swear an information in
respect of any offence under this Act or any regulations made under this
Act before a Magistrate.

(2)

Notwithstanding any other enactment, the Intermediate Court shall

have jurisdiction to try an offence under this Act or any regulations made
under this Act.
(3)

No prosecution shall be instituted under this Act except by, or with the
consent, of the Director of Public Prosecutions.

64.

Consequential amendments
(1)

The Criminal Code is amended by repealing section 300A.

(2)

The Information and Communication Technologies Act 2001 is

amended –
(a)

in section 2, by deleting the definitions of “code of practice” and
“personal data”;

(3)

(b)

by repealing section 33;

(c)

by repealing the Fourth Schedule.

The National Computer Board Act is amended –
(a)

In section 2, by deleting the definitions of “computer service
person”, “data”, “data user”, and “personal data”;

(b)

in section 4, by deleting paragraph (d); and
