Broadcasting organisations
33. A broadcasting organisationhasthe exclusiverightto authoriseor prohibit,
(a) the rebroadcastingof its broadcast,
(b) the fixationof its broadcast, or
(c) the reproduction of a fixation of its broadcast,or
(d) the communicationto the public of its broadcast.
Programme carrying signals
34. Abroadcasting organisation hastherightin relation toitsprogramme carrying
signals, to prevent the distribution in the Republic or from the Republic of any
signalsby any distributorfor whom the signalswerenot intended.
Limitation oneconomic rights of performers andbroadcasting organisations
35. The provisions of sections 28 and 33 of this Act shall not apply where the
acts referred to are concerned with
(a) privateuse,
(b) the reporting of currentevents,whichinvolvesthe use of onlyshort
excerpts of a performance, sound recording, audio visual work or
broadcast,
(c) teaching or scientific research,
(d) quotations in the form of short excerpts of a performance, sound
recording, audio-visual work orbroadcast, which arecompatible with
fair practice and are justified by the informative purpose of those
quotations, and
(e) cases where, under permitted users of copyright in sections 19 to
23 a work can be used without the authorisation of the author or
other owner of the copyright.
Durationof rights of broadcasting organisation
36. The rights of a broadcastingorganisationreferred to in sections33, and 34
areprotected until theexpiration of forty yearsfromthedateof makingthe broadcast
or the signal.
Publicperformance anduse of copyright work
37. (1) Where inany public placebymeans ofbroadcasting,cinematography,jukebox
or other apparatus,a sound recording or audio visualwork is usedthe authorised
performerandproducer of thesoundrecordingor audio visual workshall beentitled
to royaltyin accordancewith thisAct.
(2) An owner of copyright is entitled to collect royalties for the live
performance of the copyright work or for the public performance of the recorded
copyrightwork.
