(2) The powers of the court
under sub-section (1) shall be subject to
the following:
(a) the Authority shall not be
obliged to make any
submissions unless the
matter in respect of
which such submissions
are
required
relates
specifically to electronic
or
postal
communications;
(b) any submissions made by
the Authority shall be (i)
considered by the
court but not be
binding upon the
court;
(ii) confined to the legal
and technical issues
relevant
to
the
proceedings
concerned, and shall
not deal with the
factual aspects of
those proceedings
unless the court
specifically require
the Authority to
make submissions
on such factual
aspects;
(iii)
made on oath to the
extent that they deal
with the factual
aspects
of
the
proceedings
