(4) The performer shall, independently of his or her
economic rights and even after the transfer of those rights, have
the right to claim to be identified as the perfonner of his or her
perfom1ances, except where omission is dictated by the
manner of the use of the performance, and to object to any
distortion, mutilation or other modification of his or her
performances that would be prejudicial to his or her reputation.
(5) Any modifications consistent with the normal
exploitation of a performance in the course of a use authorised
by the performer shall not be considered prejudicial to the
performer's reputation and the provisions of section 8 (2) and
(3) shall apply, mutatis mutandis, to the rights tmder this
subsection.
(6) The rights under this section shall be protected until
the end of the fiftieth calendar year following the year in which
the performance took place.
Rights of
phonogram
producers
24.( 1) A producer of a phonogram shall have the exclusive
right to carry out or to authorise any of the following acts-
(a) the direct or indirect reproduction of the
phonogram, in any manner or form;
(b) the distribution of the original or copies of
the phonogram to the public;
(c) the rental of a copy of the phonogram to the
public; or
(d) the making available to the public of the
phonogram_, by wire or wireless means, in
such a way that members of the public may
access it from a place or at a time individually
chosen by them.
(2) The right of distribution under subsection (1 )(b)
shall not apply to the original or the copy of the phonogram that
