60 Offence and penalties
A person who contravenes the provisions of section 56 (6) shall be guilty of an offence and
liable on conviction to a fine not exceeding N$12 000 or to imprisonment for a period not
exceeding three years, or to both such fine and such imprisonment.
PART IV
GENERAL AND MISCELLANEOUS PROVISIONS

61 Regulations
The Minister may make regulations by notice in the Gazette(a) in relation to any matter required or permitted by this Act to be prescribed;
(b) prescribing the procedure for making references and applications to the Tribunal and for
proceedings before the Tribunal;
(c) in consultation with the Minister of Finance, prescribing the tariff of fees payable in
respect of proceedings before the Tribunal;
(d) in consultation with the Minister of Finance, prescribing the remuneration and allowances
of members of the advisory committee referred to in section 62, and of its subcommittees,
and the conditions upon which such members shall be appointed; and
(e) generally, as to any matter which the Minister considers it necessary or expedient to
prescribe in order that the objects of this Act may be achieved.

62 Advisory committee
(1) The Minister shall appoint an advisory committee on copyright and neighbouring rights
law, consisting of(a) a chairperson who shall be a person who has practised as an advocate or attorney for a
period of not less than five years; and
(b) such ex officio and other members as the Minister may from time to time determine.
(2) A member of the advisory committee shall hold office for such period as the Minister may
direct and shall be eligible for re-appointment upon the expiration of his or her period of
office.
(3) The advisory committee shall in relation to witnesses and their evidence have the powers
of a commission under the Commissions Act, 1947 (Act 8 of 1947).
(4) The advisory committee may from time to time make recommendations to the Minister in
regard to any amendments to this Act and shall advise the Minister on any matter referred to
it by the Minister.
(5) (a) The advisory committee may from time to time constitute and maintain
subcommittees.
