data, that comes to his knowledge or to which he has access by reason of
his position as Commissioner or authorised officer, shall commit an
offence.
(4)
Any person, who without lawful excuse, contravenes subsection (2),
shall commit an offence and shall, on conviction, be liable to a fine not
exceeding 50,000 rupees and to imprisonment for a term not exceeding 2
years.

PART III - POWERS OF COMMISSIONER
7.
Powers of Commissioner
The Commissioner shall have power, for the purpose of carrying out his functions
to do all such acts as appear to him to be requisite, advantageous or convenient
for, or in connection with the carrying out of these functions.

Powers to obtain information
Subject to section 26 of the Bank of Mauritius Act, section 64 of the Banking Act,
section 83 of the Financial Services Act and section 30 of the Financial Intelligence and
Anti-Money Laundering Act –
(a)
the Commissioner may, by notice in writing served on any
person, request from that person, such information as is
necessary or expedient for the performance of his functions and
exercise of his powers and duties under this Act; and
(b)
where the information requested by the Commissioner is stored
in a computer, disc, cassette, or on microfilm, or preserved by
any mechanical or electronic device, the person named in the
notice shall produce or give access to the information in a form in
which it can be taken away and in which it is visible and legible.
