(b) a work by an author who has renounced his
or her rights; and
(c) a fore ign work that does not enjoy protection

(2) For the purposes of subsection ( 1 ) (b), renunc iation
by an author or his or her successor in title of his or her
r ig hts provided under sections 9 and 1 0 s hall be in
writing and made public, but the renunciation shall not
conflict w ith any previous contractual obligation relating

(3) For the purposes of this section, ·public domain"

means copyright works whic h do not enjoy protection
because of the expiration of the term of protection or in
the case of foreign works , those which lack international
conventions and treaties to ensure protection .

(4) Subject to the payment of such fee as may be

specif ied by the Centre, a work that has fallen into the
public domain may be used without any restriction.
Registration of
works

49. ( 1 ) T he Centre shall open and ma inta in registers in
which shall be registered works, productions and
associations of au thors .
(2) T he purposes of registration are to(a) ma intain a record of works ;
(b) publicise the rights of the owners ; and
(c) 	 provide evidence of the ownership and
authentication of intellectual property .
