(4) The revocation of a licence shall take effect where there is no
appeal against the revocation, on the expiration of thirty days from
the date on which the notice of revocation is served on the licensed
certification service provider.
(5) Where an appeal has been made against the revocation of a
licence, the certification service provider whose licence has been
revoked shall not issue any certificates until the appeal has been
disposed of and the revocation has been set aside by the Minister but
nothing in this subsection shall prevent the certification service
provider from fulfilling its other obligations to its subscribers during
that period.
(6) A person who contravenes subsection (5) commits an
offence and is liable, on conviction, to a fine not exceeding two
hundred and forty currency points or to imprisonment not exceeding
ten years or both.
(7) Where the revocation of a licence has taken effect, the
Controller shall, as soon as practicable, cause the revocation to be
published in the certification service provider disclosure record he or
she maintains for the certification service provider concerned and
advertised in at least two English language national daily newspapers
for at least three consecutive days.
28. Appeal.
(1) A person who is aggrieved by—
(a) the refusal of the Controller to license a certification service
provider under section 26 or to renew a licence under section
35; or
(b) the revocation of a licence under section 27,
may appeal in writing to the Minister within thirty days from the date
on which the notice of refusal or revocation is served on that person.
(2) The Minister shall, upon receipt of the appeal respond within
thirty days.
26
