agree on the onward processing of the request, where necessary, by subjecting it to
compliance with such conditions.
(5) Irregularity in the transmission of the request for judicial assistance shall not constitute
grounds for nullity of actions undertaken in enforcing such a request.
Section 94. (1) Where the enforcement of a request for judicial assistance from a foreign
judicial authority is such as can breach public law and order or negatively affect the essential
interests of the Nation, the State Counsel to whom the request is addressed or who is
appraised thereof shall forward same to the General Prosecutor who shall transmit to the
Minister in charge of Justice and where necessary, inform the State Counsel of such
transmission.
(2) Where the request is forwarded to the Minister in charge of Justice, he shall inform the
requesting authority, where necessary, that it is not possible to totally or partially accede to
the request. Such information shall be communicated to the judicial authority concerned and
shall block the enforcement of the request for mutual judicial assistance or the return of the
enforcement papers.
PART V
TRANSITIONAL AND FINAL PROVISIONS
Section 95. The conditions of applications of this law shall, and as when necessary, be laid
down by implementation instruments.
Section 96. Authorizations and declarations for the supply, import and export of
cryptographic devices issued by the relevant authorities shall remain valid until the expiry of
the time-limit specified therein.
Section 97. This law shall be registered, published according to the procedure of urgency and
inserted in the Official Gazette in English and French.
