ECONOMIC PLANTS PROTECTION ACT, 1979

AN ACT to provide for the prohibition of the destruction of specified plants of economic value and for related matters.
1. Destruction of specified plants prohibited
A person who,
(a) without the written authority of the Minister, or
(b) for purposes other than for horticultural husbandry,
intentionally destroys or causes the destruction of a specified plant commits an offence.
2. Payment of compensation
(1) Where a Court convicts a person of an offence under section 1, the Court shall
order that person to pay compensation in respect of every specified plant destroyed, in
addition to the punishment imposed under section 5.
(2) The Minister may give written authority under section 1 (a) on condition that
compensation shall be paid in respect of each specified plant destroyed.
(3) The compensation shall be paid, in the case of a court order, within seven days of
the order, and in the case of a written authority given by the Minister, within the period
specified by the Minister.

the 21st day of September, 1979 and notified in the Gazette on 22nd September, 1979.
