The Vice-President shall, before commencing to perform the functions of the President under clause
(6) of this article, take and subscribe the oath set out in the Second Schedule to this Constitution in
relation to the office of President.
(10)
The Vice-President shall, upon assuming office as President under clause (6) of this article, nominate
a person to the office of Vice-President subject to approval by Parliament.
(11)
Where the President and the Vice-President are both unable to perform the functions of the
President, the Speaker of Parliament shall perform those functions until the President or the
Vice-President is able to perform those functions or a new President assumes office, as the case may
be.
(12)
The Speaker shall, before commencing to perform the functions of the President under clause (11) of
this article, take and subscribe the oath set out in relation to the office of President.
(13)
Where the Speaker of Parliament assumes the office of President as a result of the death, resignation
or removal from office of the President and the Vice-President, there shall be a presidential election
within three months after his assumption of office.
(14)
The provisions of article 69 of this Constitution shall apply to the removal from office of the
Vice-President.
61 PUBLIC AND PRESIDENTIAL SEALS
There shall be a public seal and a presidential seal, the use and custody of which shall, subject to the
provisions of this Constitution, be regulated by law.
62 QUALIFICATIONS OF PRESIDENT
A person shall not be qualified for election as the President of Ghana unless—
(a) he is a citizen of Ghana by birth;
(b) he has attained the age of forty years; and
(c) he is a person who is otherwise qualified to be elected a Member of Parliament, except that the
disqualifications set out in paragraphs (c), (d), and (e) of clause (2) of article 94 of this
Constitution shall not be removed, in respect of any such person, by a presidential pardon or by
the lapse of time as provided for in clause (5) of that article.
63 ELECTION OF PRESIDENT
(1)
A person shall not be a candidate in a presidential election unless he is nominated for. election as
President by a document which—
(a) is signed by him; and
(b) is signed by not less than two persons who are registered voters resident in the area of authority
of each district assembly;
(c) is delivered to the Electoral Commission on or before the day appointed as nomination day in
relation to the election;
(d) designates a person to serve as Vice-President.
