Commission

(1)

There shall be a Public Service Commission for The
Gambia.

(2)

The Public Service Commission shall comprise a
Chairman and not less than two nor more than four
other members. The members shall be persons of
high integrity and good character and shall be
appointed by the President. All the members of the
Commission shall be full time members.

(3)

A person shall not be qualified to be appointed a
member of the Public Service Commission if he or
she(a)
(b)
(c)
(d)
(e)

(f)

is a member of a public service or a member
of a disciplined force;
is a member of the National Assembly or of
a local government authority;
is a member of governing body of a Public
enterprise;
is a member of the governing body of a
political party;
has, within the two years preceding his or
her appointment, been nominated as a
candidate in an election to the National
Assembly; or
is not qualified to be elected as a member of
the National Assembly or is disqualified
from holding an office in the public service.

(4)

A member of the Public Service Commission shall
not hold any other public office and shall be
disqualified for appointment to any office in the
public service during a period of three years after he
or she ceases to be a member of the Commission.

(5)

Subject to the provisions of this section, the
members of the Public Service Commission shall be
appointed for a term of two years which term shall
be renewable.

Provided that half of the members first appointed after the
coming into force of this Constitution shall be appointed
for shorter terms in order to provide continuity in the
Commission.
(6)

A member of the Public Service Commission may
be removed from office by the President only for
