(a)
in the case of an operator not having a significant market power,
at any time after the specified period of 15 days referred to in
subsection (8)(a); or
(b)
in the case of an operator having a significant market power,
at any time after its tariff or alteration has been allowed by the
Authority,
disallow or amend the tariff or alteration where –
(i)
the information submitted under subsection (2)(b) or (5),
as the case may be, is found to be incorrect or misleading in a
material particular;
(ii)
the tariff or alteration –
(A)
is
not
calculated
in accordance with
such
guidelines as the Authority may issue;
(B)
is
not accompanied by information required to be
submitted under subsection (2)(b); or
(C)
is otherwise in contravention of the Act or a directive
issued by the Authority.

32.
Confidentiality
(1)
(2)
Every member or officer of the Authority shall (a)
before he begins to perform his duties under this Act, take the oath set out
in the Third Schedule;
(b)
maintain, and aid in maintaining, the secrecy of any matter which comes to
his knowledge in the performance, or as a result, of his duties under this
Act.
Any person who, without legal cause or reasonable excuse, contravenes
subsection (1)(b) shall commit an offence.
