(1)

Where the Authority determines that a public operator has significant market
power in a relevant market or market segment, it may impose such conditions as it
considers appropriate on the public operator.

(2)

Every public operator with significant market power shall comply with every
condition imposed by the Authority under subsection (1).

(1)

Tariffs

Every p u b l i c o p e r a t o r s h a l l s u b m i t t o t h e Authority, in such form and
manner as the Authority may determine, a tariff for every information and
communication service which it wishes to supply and every intended alteration to a
tariff, at least 15 days before the implementation of the tariff or the alteration, as the
case may be.

(2)

Every t a r i f f o r a l t e r a t i o n s u b m i t t e d t o t h e Authority under subsection (1)

shall –
(a)

be calculated

in

accordance

with

such guidelines as the

Authority may issue;

(b)

include information relating to –
(i)

the term during which the tariff or alteration is to apply;

(ii)

the description of the information and communication
service;

(iii)

the amount of all charges payable for each information
and communication service, including the amount of
any surcharge that may be imposed as a result of nonpayment of fees or charges and the cost-related computation
thereof;

(iv)

the b r e a k d o w n o f cost and cost elements involved in
