(2) The Commission shall upon receipt of an application, consider it
and within not more than sixty days, may in its absolute discretion,
either grant a licence or refuse the application'
(3) A licence granted under subsection (1) of this section may he
renewed on its expiry on application within the prescribed period which
shall be decided by the Commission.
(4) No licence shall be transferred except with the prior consent in
writing of the Commission.
19.-(I) Subject to this Section the Commission may modify the conditions of a licence granted under sections 9, 10, 11, 12, 13, 14 and 15.
(2) Before making modifications of the conditions of a radio frequency
licence or a licence of a public telecommunication or postal licensee
under this section the Commission shall give notice to the licensee(a) stating that it proposes to make modifications in the manner as
specified in the notice and the compensation payable for any
damage caused thereby; and
(b) specifying the time (not being less than twenty eight days from
the date of service of the notice on such a licensee) within which
written representation in respect to the proposed modifications
may be made.
(3) Upon receipt of any representation referred to in subsection (2),
the Commission shall consider such a representation and may
(a) reject the representation; or
(b) amend the proposed modifications or compensation payable in
accordance with the r&presentation, or otherwise, and, in either
event, it shall thereupon issue a direction in writing to such a
licensee requiring that effect be given to the proposed modifications specified in the notice or to such modifications as subsequently amended by the Commission within reasonable time.
(4) Any licensee aggrieved by the decision of the Commission under
subsection (3) may, within fourteen days of the receipt by it of the
direction, appeal to the High Court on procedural issues, or on grounds
that the decision of the Commission was based on extraneous factors.
The decision of the court shall be final.
(5) The Commission shall not enforce its direction
(a) during the period referred to in subsection (4); or
(b) while the appeal of the licensee is under consideration by the
court.
(6) If no written representation is received by the Commission within
the time specified in subsection (2) or if any written representation made
under subsection (2) is subsequently withdrawn, the Commission may
forthwith carry out the modifications as specified in the notice given
under subsection (2).
