BERGER AJ:
Introduction
[1] The applicant ("Moneyweb") and the first respondent ("Media24") are both in the business of publishing
articles on the internet. These are not their only activities but, for purposes of this case, it is not necessary to
list their full range.
[2] Moneyweb publishes business, financial and investment news, primarily on the internet, but also on other
digital platforms. Media24 publishes online magazines and newspapers, including Fin24, an online financial
publication. Moneyweb and Media24 are therefore direct competitors. The second respondent was the editor
of Fin24 at all relevant times.
[3] Moneyweb seeks a declaration that the publication of seven articles by Media24 was unlawful. Moneyweb
contends that Media24 infringed its copyright under the Copyright Act 98 of 1978 ("the Act"), alternatively that
Media24 has engaged in unlawful competition. It also seeks to interdict the continued publication of the
articles, and a further declaration that Media24 and the second respondent are liable for the damages
suffered by it as a result of the publication of the articles. All the articles were published under the banner of
Fin24.
