and delete o t h e r s ; to p r o v i d e for t h e c o m p o s i t i o n of the W i n e a n d Spirit B o a r d ; to
a m e n d the r e q u i r e m e n t s r e g a r d i n g w i n e ; to e x t e n d the p a r t i c u l a r s required in
c o n n e c t i o n with t h e sale of l i q u o r p r o d u c t s in c o n t a i n e r s ; to e m p o w e r the M i n i s t e r
to prohibit the u s e of g e o g r a p h i c a l n a m e s u n d e r certain c i r c u m s t a n c e s ; to m a k e
other provisions for the e s t a b l i s h m e n t of s c h e m e s ; to curtail the b o a r d ' s p o w e r
r e g a r d i n g the i m p o r t and e x p o r t o f l i q u o r p r o d u c t s ; to p r o v i d e for c o m p l i a n c e with
international o b l i g a t i o n s ; a n d to e x t e n d the M i n i s t e r ' s p o w e r to m a k e regulations;
and to provide for m a t t e r s c o n n e c t e d t h e r e w i t h .

A m e n d m e n t of section 1 of Act 6 0 of 1989
1. Section 1 of the Liquor P r o d u c t s Act, 1989 (hereinafter referred to as the principal
Act), is hereby a m e n d e d —
(a) by the substitution for the definition of " c o n t a i n e r " of the following
definition:
" ' c o n t a i n e r ' m e a n s a [receptacle] container with a capacity not
e x c e e d i n g [5] five l i t r e s ; " :
(b) by the substitution for the definition of " d e p a r t m e n t " of the following
definition:
'"•department' m e a n s the D e p a r t m e n t of [Agricultural E c o n o m i c s
and Marketing] Agriculture:":
(c) by the substitution for the definition of " g r a p e s " of the following definition:
" ' g r a p e s ' m e a n s fruit of plants of Vitis [vinifera];'"; and
(d) by the insertion after the definition of " i m p o r t certificate" of the following
definition:
" ' i n t e r n a t i o n a l o b l i g a t i o n s ' includes the T r a d e - R e l a t e d Intellectual
Property Rights or the W i n e and Spirit A g r e e m e n t ; " .
