38. (1) In
similar conditions and
similar
transparency. circumstances, interconnection shall be provided on a
non-discriminatory basis and an interconnection provider shall
ensure that-
Non-discrimination
and
(a)
the rates charged do not vary on the basis of the
class of customers to be served;
(b)
it provides interconnect operators with
interconnection facilities and information under
the same conditions and in the same quality that
it affords to its subsidiaries, affiliates, or other
similarly situated telecommunications service
providers; and
(c)
it avails to interconnect operators all necessary
information and specifications related to
interconnection ; and
(d)
Quality of service.
customers of an interconnect operator receive
treatment that is no less favourable than the
treatment which it affords to its own customers
or the customers of its subsidiaries, affiliates, or
other similarly situated telecommunications
service providers.
39.(1) Interconnection agreements shall provide for
adequate capacity, service levels and reasonable remedies for
any failure to meet those service levels.
(2)
Parties to an interconnection agreement shall
comply with all relevant service standards of the
International Telecommunications Union and such other
technical standards as the Commission may from time to time
determine.
Good faith
negotiations.
40. (1) Parties to an interconnection agreement shall
negotiate in good faith and use their reasonable endeavours to
resolve disputes as to the form and subject of an
interconnection agreement.
