A BILL
ENTITLED

An Act to establish the Public Information Commission and define
its functions; to provide for the right of access to information;
to set out the scope of public information under the control of
public authorities to be made available to the public in order to
facilitate more effective participation in the good governance
of Zambia; to promote transparency and accountability of public
officers; and to provide for matters connected with or incidental
to the foregoing.

PART I
PRELIMINARY
1. (1) This Act may be cited as the Freedom of Information Act,
5 2002.
(2) This Act shall come into operation on such date as the Minister
may, by statutory instrument, appoint provided that the Minister shall
not appoint a day that is later than six months after the passing of the
Act.

2. In this Act, unless the context otherwise requires—
“ appointments committee ” means an appointments committee
appointed under paragraph 3 of the First Schedule;
“ Chairperson ” means the person appointed as Chairperson under
section five;
“ Commission ” means the Commission established under section
five; “ Director ” means the person appointed as Director
under section nine;
“ head of a public authority ” in relation—
(a) to a government Ministry or department means the
Permanent Secretary or any other person so
designated; or
