establishment or operation of information and
communications networks or systems, to the extent
required to guarantee the efficient use of the radiofrequency spectrum or for the time required to
allow sufficient numbers to be allocated.
(2) Where the Minister intends to limit the number
of individual licences granted in conformity with
subsection (1), he or she shall
(a) give due consideration to the necessity
to maximize advantages for users and
facilitate
the
development
of
competition;
(b) give interested parties the opportunity to
express their opinion on any planned
limitation;
(c) consult the Authority prior to reaching a
decision;
(d) publish the decision to limit the number
of
individual
licences
and
the
justification of the decision;
(e) regularly re-examine the limit imposed;
(f) launch a public tender for the issue of
licences.
(3) Where the number of licences is limited, the
Minister, in consultation with the Authority, shall
establish in terms of reference for each call for
tender for an individual licence
(a) the conditions for the establishment of the
network;
(b) the conditions for the provision of the
service;
(c) the coverage area of the service and imple
mentation schedule;
(d) the radio frequencies and blocks of numbers
