(c)

provides information under this Act which is false or misleading in
any material particular;

(d)

otherwise contravenes this Act,

shall commit an offence and shall, on conviction, be liable –
(i)

on a first conviction to a fine not exceeding Rs 50,000 and
to imprisonment for a term not exceeding 2 years;

(ii)

on a second or subsequent conviction, to a fine not
exceeding Rs 100,000 and to imprisonment for a term not
exceeding 4 years.

(2)

In addition to any penalty under subsection (1), the Court may order the
forfeiture of any animal, plant, organism or any article used in, or
connected in any way with, the commission of an offence.

23.

Jurisdiction
(1)

An authorised officer may swear an information and conduct prosecution
in respect of an offence under this Act before a Magistrate.

(2)

Notwithstanding section 114 of the Courts Act and section 72 of the
District and Intermediate Courts (Criminal Jurisdiction) Act, a magistrate –

(a)

shall have jurisdiction to try an offence under this Act; and

(b)

may impose any penalty and forfeiture provided by this Act.

Regulations
(1)

The Minister may make such regulations as he thinks fit for the purposes
of this Act.
