NOTICE IN TERMS OF THE COPYRIGHT ACT, 197%
(ACT NO. 98 OF 1978)

I, MANDlSl MPAHLWA, Minister of Trade and Industry, hereby, in terms of
section 39 of the Copyright Act, 1978 (ACT No 98 of 1978), publish Regulations
on the Establishment of Collecting Societies in the Music Industry,
These Regulations will come into effect on the date of publication of this Notice.

In the main the Regulations provide for the following:
1. Criteria to be followed by the accrediting authority (Registrar of CIPRO)
2. Powers and functions of the Registrar
3. Obligations of collecting societies
4. Administration of rights
5. Licensing
6. Distribution
7. Entry into force
The scope of the Regulations is the one described in terms of section 9A of the
Copyright Act, 1978 and section 5 (3) of the Performers Protection Act, 1967,
During stakeholder consultations, there was a common understanding that ell
rights in the copyright regime should be managed through collecting societies in
future.
During stakeholder consultations there was a common understanding that the
Regulationswill not apply to Community Radio Sfations.
