If a defendant files an appearance after the time prescribed in the originating process, he shall pay
to the Court an additional fee of N200.00 (Two Hundred Naira) for each day of default.

(1)A defendant appearing in person shall state in the memorandum of appearance an address for
service which shall be within the Judicial Division of the Court including mobile telephone number and Email address where available.
(2)
Where a defendant appears by a legal practitioner, the legal practitioner shall state in the
memorandum of appearance his place of business and an address for service which shall be within the
Judicial Division of the Court including mobile telephone number and E-mail address where available and
where any such legal practitioner is only the agent of another legal practitioner, he shall also insert the
name and place of business of the principal legal practitioner.

The Registrar shall not accept any memorandum of appearance which does not contain an
address for service.
Defendants appearing through same legal practitioner

If two or more defendants in the same action appear through the same legal practitioner, the
memorandum of appearance shall include the names of all defendants so appearing.

DEFAULT OF APPEARANCE
Default of appearance generally

Where any defendant fails to appear, a plaintiff may proceed upon default of appearance under
the appropriate provision of these Rules upon proof of service of the originating process.

Where the claim in the originating process is a liquidated demand and the defendant or all of
several defendants fail to appear, a plaintiff may apply to a judge for Judgment for the claim on the
originating process or such lesser sum and interest as the judge may order.
