CHAPTER X—REPEAL AND TRANSITIONAL PROVISIONS
PART I—REPEAL AND SAVINGS
150.—(1) The following Acts (“the repealed Acts”) are hereby repealed—
(a) the Nigerian Communications Commission Act ;
(b) the Nigerian Communications Commission (Amendment) Act ; and
(c) the Telecommunications and Postal Offences Decree No. 21 of 1995 and
all subsequent amendments thereto.

(2) Any subsidiary legislation made under the repealed Acts shall, in so far as
it is not inconsistent with this Act, remain in operation until revoked or replaced by
subsidiary legislation made under this Act, and shall be deemed for all purposes to
have been made under this Act.
151.—(1) The rights, interests, obligations and liabilities of the Commission,
existing before the commencement of this Act under any contract or instrument, or
in law or in equity shall by virtue of this Act be deemed to have been preserved,
assigned to and vested in the Commission established by this Act to the extent that
they are not inconsistent howsoever with any of the provisions of this Act.

(2) Any such contract or instrument as is mentioned in subsection (1) of this section
shall be of the same force and effect against or in favour of the Commission established
by this Act and shall be enforceable as fully and effectively as if instead of the Commission
existing before the commencement of this Act the Commission established by this Act
had been named therein or had been a party thereto provided that such contract or
instrument is not inconsistent with any of the provisions of this Act.
152. The Commission established by this Act shall be subject to all the obligations
and liabilities to which the Commission existing before the commencement of this Act
was subject to immediately before the commencement of this Act and all other persons
shall have the same rights, powers and remedies against the Commission established
by this Act as they had against the Commission existing before the commencement of
this Act provided that such obligations, liabilities, rights, powers and remedies are not
inconsistent with any of the provisions of this Act.

153. Any proceeding or cause of action pending or existing immediately before
the commencement of this Ad by or against the Commission in respect of any right,
interest, obligation or liability of the Commission pursuant to the repealed Acts may be
continued or, as the case may be, commenced and any determination of the court of
law, tribunal or other authority or person may be enforced by or against the Commission
established by this Act as if such proceeding or cause of action or determination was
continued, commenced or enforced by or against the Commission under this Act
provided that such proceeding or cause of action or determination is not inconsistent
with any of the provisions of this Act.

154. All assets, funds, resources and other movable or immovable property
which immediately before the commencement of this Acts were vested in the
Commission pursuant to the repealed Acts shall by virtue of this Act and without
further assurance, be vested in the Commission established by this Act.
