A n Act to develop a safe, secure and effective e n v i r o n m e n t
for the c o n s u m e r , b u s i n e s s s e c t o r a n d t h e G o v e r n m e n t
to c o n d u c t and use electronic c o m m u n i c a t i o n s ; p r o m o t e
legal certainty and confidence, and e n c o u r a g e i n v e s t m e n t
and innovation, in the electronic c o m m u n i c a t i o n s industry;
facilitate the c r e a t i o n of s e c u r e c o m m u n i c a t i o n s y s t e m s
and networks; establish t h e Central Monitoring and
C o o r d i n a t i o n Centre and define its functions; repeal the
C o m p u t e r Misuse and C r i m e s Act, 2 0 0 4 ; and provide for
matters c o n n e c t e d w i t h or incidental to the foregoing.

Enactment
PART I
PRELIMINARY
1. This A c t m a y be cited as the Electronic C o m m u n i c a t i o n s
and Transactions Act, 2009, and shall come into operation on such
date as the Minister may, by statutory instrument, appoint.
2.
In this Act, unless the context otherwise r e q u i r e s —
" access " in relation to a computer system or electronic
c o m m u n i c a t i o n system, m e a n s the right to use or open the
whole or any part of the computer system or electronic
c o m m u n i c a t i o n system, or to see, open, use, get or enter
i n f o r m a t i o n in t h e c o m p u t e r s y s t e m o r e l e c t r o n i c
communication system, with authorisation from the owner
or operator thereof;
