(3) The Minister may designate any other authentication service
provider as a preferred authentication service provider based on
such authentication service provider's obligations in respect of the
provision of universal access.

PART IV
CRYPTOGRAPHY PROVIDERS

2 2 . (1)
A person shall not provide cryptograph services
or products in Z a m b i a without registration under this Part.
(2) A cryptograph service or product shall be treated as being
provided in Z a m b i a if it is p r o v i d e d —
(a) from any premises in Zambia;
(b) to a person w h o is present in Z a m b i a where that person
makes use of the service or product; or
(c) to a person who uses the service or product for the purposes
of a business carried on in Z a m b i a or from premises in
Zambia.
(3) A person w h o c o n t r a v e n e s subsection (1) c o m m i t s an
offence and is liable, upon conviction, to a fine not exceeding seven
hundred thousand penalty units or to imprisonment for a period not
exceeding seven years, or to both.
(4) A person w h o intends to provide a cryptograph service or
product shall apply to the Authority for registration in the prescribed
m a n n e r and form upon payment of the prescribed fee.
(5) The Minister may, on the recommendation of the Authority,
by statutory instrument, make regulations to provide for (a) t h e p r o c e d u r e for t h e r e g i s t r a t i o n o f c r y p t o g r a p h y
providers;
(b) the forms to be used for registration purposes under this
Part and the fees to be paid;
(c) t h e i n f o r m a t i o n and other details to be s u p p l i e d by
applicants for registration; and
(d) any other matter necessary to give effect to the provisions
of this Part.
