1/ If the record exists in the language that the requester prefers, be given access in that
language; or
2/ If the record does not exist in the language preferred, be given access in any language
the record exists.
31. Appeals Against Refusals of Information
1/Any person who is aggrieved by the decision of the public relation officer under this part
may lodge his appeal to the concerned head of public body within 30 days from the day the
decision is made.
2/If the appellant can prove sufficiently that he could not lodge his appeal due to force
major, the head of the public body may accept the appeal after the lapse of period referred
to in sub-article (1).
3/The head of the public body to which the appeal is lodged shall give a decision with in 10
days.
4/ Any person who is aggrieved by the decision of the head of the public body may lodge
his appeal the to Ombudsman within 30 days of receiving that decision.
32 Responsibilities of the Ombudsman
1/ The ombudsman shall within 18 months after the commencement of Part Three of this
Proclamation compile a guide, in an easily comprehensible form and manner, as may be
required by a person who wants to exercise his right under this section, which contains –
a)the objects of this section;
b)the address of the public relation officer of each public body and the deputy officer;
c) the description of the main functions of every public body;
d)the manner and form of request for information under Article 12 of this Proclamation;
e)the assistance available from the public relation officer in terms of this proclamation;
f)the assistance available from the Ombudsman institute in terms of this proclamation;
g)legal remedies available regarding failure to comply with a right or duty conferred or
imposed by Part Three of this Proclamation;
