4. The Rules of Procedure for the Council of the Republic shall be approved by
Presidential decree.
Article 136
(National Security Council)
1. The National Security Council shall be a consultative body to the President of
the Republic in matters relating to national security policies and strategies, in
addition to the organisation, functioning and regulation of the Armed Forces,
the National Police Force and other organs which guarantee the constitutional
order and, in particular, the state intelligence and security bodies.
2. The National Security Council shall be presided over by the President of the
Republic and shall be composed of the following:
a) The Vice-President of the Republic;
b) The President of the National Assembly;
c) The President of the Constitutional Court;
d) The President of the Supreme Court;
e) The Attorney General of the Republic;
f) Ministers of State and Ministers nominated by the President of the
Republic;
g) Other entities nominated by the President of the Republic.
3. The organisation and functioning of the National Security Council shall be
defined by Presidential decree.

ACTS, INCOMPATIBILITIES AND LIABILITY OF MINISTERS OF
STATE, MINISTERS, SECRETARIES OF STATE AND VICE-MINISTERS
Article 137
(Acts of Ministers of State and Ministers)
In exercising the powers delegated to them by the President of the Republic,
Ministers of State and Ministers shall issue executive decrees and dispatches that
shall be published in the Diário da Republic (Official Gazette).
Article 138
(Incompatibilities)
1. The offices of Minister of State, Minister, Secretary of State and ViceMinister shall be incompatible with the office of member of the National
Assembly and with serving as a judge or public prosecutor.
