" misuse of device'* means the production, sale, procurement
for use, distribution, possession or o t h e r w i s e m a k i n g
available, of a computer password, access code or data by
which the whole or any part o f a c o m p u t e r system is
capable of being accessed, or a device or computer program
designed or adapted primarily for the purpose of committing
an offence;
* Monitoring Centre " means the Central Monitoring and
Coordination Center established pursuant to section sixtyfive;
" natural person " means an individual;
" oral communication " means a verbal communication or
any communication through sign language, but does not
include any electronic communication;
" o r i g i n a t o r " means a person by whom, or on whose behalf,
a data message purports to have been sent or generated
prior to storage, if any, but does not include a person acting
as an intermediary with respect to that data message;
" person '* includes a public body;
" p e r s o n a l i n f o r m a t i o n " m e a n s i n f o r m a t i o n a b o u t an
identifiable individual, including, but not limited t o —
(a) information relating to the race, gender, pregnancy,
marital status, nationality, ethnic or social origin,
colour, age, physical or mental health, well-being,
disability, religion, belief, culture, language and birth
of the individual;
(b) information relating to the education or the medical,
criminal or employment history of the individual,
or information relating to financial transactions in
which the individual has been involved;
(c) any identifying number, symbol, or other particular
assigned to the individual;
(d) t h e a d d r e s s , f i n g e r p r i n t s or b l o o d t y p e o f t h e
individual;
(e) the personal opinions, views or preferences of the
individual, except where they are about another
individual or about a proposal for a grant, an award
or a prize to be made to another individual;
(f) correspondence sent by the individual that is implicitly
or explicitly of a private or confidential nature, or
further c o r r e s p o n d e n c e that w o u l d reveal t h e
contents of the original correspondence;
