As to the remedies prayed by the plaintiff and in order to avoid the possibility of the defendant
reintroducing the Marie biscuit in a manner that will cause confusion and allow for deception I
grant an injunction against the defendant using a similar get up to that of the plaintiff. This
however does not extend to the production of the biscuit itself as it is a generic type of biscuit.
I make no award of damages for the reasons given before.
I however award the plaintiff the costs of the suit.
